NotaryPublicSearch.com (here in after referred as "NPS") agrees to provide database listing services to the Customer ("Notary Public" who choose to list with NPS), subject to the following TOS (Terms of Service).
- NPS reserves the right to refuse service to any customer.
- Customer acknowledges that NPS has clearly explained to them the nature of services along with applicable rates and charges for those services.
- NPS may modify its rates and charges at any time. Such changes will apply only for new listings, or renewals.
- Customer listing will be activated within a reasonable amount of time only after NPS receives full payment for the service.
- NPS will remove customer listing from its database if customer declines to make agreed upon payments in a timely manner.
- Payments to NPS are non-refundable. Disputes if any should be resolved only via EMAIL within net 30 calendar days.
- Request for cancellation must be made via email only. Once canceled, NPS will remove all customer data from their servers or their hosting company servers.
- NPS prohibits the use of its services for illegal activities.
- Customer indemnifies NPS for any violation of the Terms of Service that results in loss to NPS or the bringing of any claim against NPS by any third party. Customer agrees to defend, indemnify and hold harmless NPS against liabilities arising out of:
- Any injury to a person (or persons) or property (or properties) caused by any products sold and/or distributed in connection with NPS services.
- Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party or copyright infringement.
- NPS will not be responsible for any damages the customer may suffer.
- NPS makes no warranties of any kind, expressed or implied for provided services.
- Customer is solely responsible for their information that they provide to NPS for listing. NPS will screen as best as they can all the content that Customer provides for their listing. Ultimately, customer will be held responsible, and fully accountable for their information. NPS shall have the right in their sole discretion to refuse any content.
- NPS reserves the right to suspend the listing of any customer if it is determined that the customer listing is in violation.
- This Terms of Service may be modified by NPS with or without notice to customer. At any given point of time, only the latest Terms of Service will be acceptable.
- Customer understands and agrees that the Service provided by NPS is on a "AS-IS" basis and that NPS assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any customer listing information.
- In consideration of customer's use of NPS Notary Database Listing Service, customer represents that he/she are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.
- Customer also agrees to: (a) provide true, accurate, current and complete information about themselves as instructed in the listing guidelines and (b) maintain and promptly update their information to keep it true, accurate, current and complete.
- If Customer provides any information that is untrue, inaccurate, not current or incomplete, or NPS has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, NPS has the right to suspend or terminate your listing without refunding any unused payment and refuse any and all current or future use of the Service (or any portion thereof).
- NPS may disclose any and all customer information requested by any law enforcement officer or agency.
- This agreement shall be bound by the laws of the State of California.
